In December 2010 the Queensland Surrogacy Act commenced, allowing for the first time, altruistic surrogacy arrangements to be made by Queensland couples. The Surrogacy Act 2010 provides a long awaited legislative pathway for couples through complex legal, medical and social issues with the outcome being (hopefully) a very welcome addition to their family.
In mid 2011 Attwood Marshall Lawyers were approached to provide advice and assistance to a Gold Coast couple who had the agreement of a surrogate to enter into a Surrogacy Arrangement pursuant to the new legislation.
In conjunction with the birth parents, their legal advisors (Evans & Company Family Lawyers) and the intended parents medical team such an agreement was negotiated and entered into before they commenced the complex medical processes designed to result in a pregnancy.
We are delighted to announce that in April, 2012 our client’s welcomed what is truly a miracle baby thanks to the kindness of a sister and her husband, the dedication and hope of a couple who dreamed of parenthood and a legal system which now finally has allowed this dream to come true.
Whilst their legal journey has not yet ended, Attwood Marshall Lawyers consider themselves lucky to have been able to provide legal assistance to our client’s in what is a relatively untouched area of law at this time. We look forward to finalising matters as is required by the Surrogacy Act 2010 to enable our client’s to simply enjoy parenthood.
