In late September 2012 the Australian Fair Work Ombudsman gave a Press Release indicating that the Ombudsman was concerned about recent reports surrounding employers attempting to attend medical appointments with employees. The Office of the Fair Work Ombudsman indicated that the Office does not condone or support the behaviour and sees no reason why an employer should seek to attend a private and confidential appointment with an employee. The Fair Work Ombudsman views the attendance of an employer with an employee’s doctor as being a breach of the employee’s privacy. The Fair Work Ombudsman believes that creating trusting relationships with employees is integral to achieving a positive and productive workplace.
Attwood Marshall have received instructions from people who have been unfairly disadvantaged when the employer enforces a policy of attending medical examinations, particularly for injured workers claiming worker’s compensation.
If you have been subject to a request from your employer that they attend your medical examination for the purposes of a work related injury please contact Attwood Marshall Lawyers for advice on 1800 621 071 or email info@attwoodmarshall.com.au.
