FAQs – Employment Law Claims

Employment Law refers to the law that governs the employee and employer relationships and contracts. Our Sydney employment lawyers represent employees (NOT employers) to ensure their workplace rights are protected.

We can assist you with:

  • Wrongful termination and unfair dismissal claims
  • Discrimination claims
  • Bullying and harassment
  • Sexual harassment claims
  • Disputes over redundancy
  • Contract disputes
  • Industrial disputes
  • Workplace accidents, injuries, and illnesses

If you are involved in a dispute with your employer, it is important to get confidential legal advice as soon as possible. By contacting our employment law team, we can help you understand your rights, and if you choose to instruct us to act on your behalf, we will then provide you with a Cost Agreement and fee estimates so you know where you stand from the start.

From this point on we will represent you every step of the way and help you negotiate a favourable outcome, or alternatively take court action if required.

The amount of compensation you may be entitled to depends on your type of claim. Your personal situation and the losses you have experienced will be taken into consideration.

The value of your compensation claim depends on your personal circumstances and the category of your claim.

In relation to unfair dismissal claims, the below will be considered:

  • Your duration of employment with the business

  • Income details
  • The potential future income you would have obtained if you hadn’t been unfairly dismissed (including incremental pay rises, promotions, etc.)
  • Your attitude and behaviour, and that of your employer
  • Disciplinary or performance circumstances
  • Whether or not you want to recommence your employment position.

In relation to workers’ compensation claims, the below will be considered:

  • Your personal circumstances.
  • The extent of your injuries
  • How much your injuries impact your ability to work and earn a living
  • Treatment requirements and the costs involved
  • Your support, care, and assistance needs (e.g. if you need help at home)
  • Your employment history and income
  • Your age

In terms of discrimination, harassment, bullying, abuse or assault claims, the below will be considered:

  • The nature of the discrimination, harassment, bullying, assault, or abuse that occurred
  • Whether you have suffered any psychological or physical injury, condition or symptoms because of the discrimination, harassment, bullying, assault or abuse

From there we will run through your claim with you and provide you with verbal and written advice to clearly explain the options you have available to you and what steps you can take next.

If you choose to pursue the matter and instruct us to act on your behalf, at this stage we will provide you with fee estimates.
