Insurance and TPD Superannuation Claims Lawyers in Sydney

NO WIN, NO FEE

If you are injured or suffer an illness or medical condition that prevents you from returning to work, it can significantly impact your life and livelihood.

Most people are unaware that they hold a Total and Permanent Disability (TPD) policy through their superannuation. This insurance covers you if you are unable to work due to an injury or illness. A TPD claim can give you the money you need for your financial security. If you are unable to work due to an injury or illness, you may also be able to claim against an income protection policy to help you with your ongoing medical expenses and costs of living.

TPD claims can be paid as a one-off lump sum payment, or alternatively, some funds pay annual instalments on the basis you continue to be deemed as totally and permanently disabled.

Different insurance policies have their own set of terms and conditions that apply so it is important to speak to an experienced TPD lawyer in Sydney who can provide you with accurate advice relating to your personal situation.

Our superannuation claim lawyers can assist you with:

  • Total and Permanent Disability (TPD) claims
  • Income protection insurance claims
  • Life insurance or death benefits
  • Trauma claims
  • Early release of superannuation

By seeking the right advice, you can ensure your TPD insurance claim is handled efficiently and you can avoid any unnecessary delays. Our Sydney TPD lawyers are trained to gain access to your benefits to ensure you receive everything you are entitled to.

A TPD payment can change your life and give you the financial security you need now and into the future. We make the process easy so that you can focus on your health, wellbeing and your family.

FAQs – Superannuation, Insurance and TPD Claims

If you are unable to work because you are injured, ill or have a medical condition, you may be eligible to make a superannuation claim.

Depending on your situation, you may be entitled to claim:

  • Total and Permanent Disability (TPD)
  • Income Protection
  • Life Insurance

Life insurance

Life insurance can provide your next of kin, or nominated beneficiary, a lump sum payment in the event of the insured person’s death.

Trauma

Regardless of whether you can work or not, you may be eligible to make a trauma claim if you have suffered an injury, medical condition, or illness.

We will be able to determine your eligibility once you grant us the permission to make enquiries on your behalf. Our Sydney Superannuation Claims Lawyers can then give you personalised advice about your potential entitlements.

For TPD claims, you must demonstrate that you are unable to work because of injury or illness, and that your medical condition and incapacity for work fit the terms of your TPD policy (i.e. that you cannot return to work in any occupation, or that you cannot return to work in your usual occupation). We can review your TPD policy to help you understand what terms and conditions apply to you.

For Income Protection claims, you must demonstrate that you are unable to work because your injury or illness currently prevents you from doing so.

For Life Insurance or Trauma claims, you must demonstrate that the terms of the policy are met. We can review your policy to help you understand what terms and conditions apply.

Every policy is different. It is vital to your claim that you obtain legal advice at the earliest opportunity to discuss your entitlements. Attwood Marshall Lawyers are here to help you access and protect what you are entitled to.

Your benefits will be paid by your insurer.

Your entitlements will be determined by what is stipulated in your insurance policy.

Most superannuation and TPD claims take between 6 and 18 months to settle. More serious or complex claims may take longer, whilst some claims can be paid out quite quickly.

If your claim is rejected, you will have the opportunity to appeal the insurer’s decision. If your appeal is unsuccessful, you may be able to take the matter to court.

It is always recommended that to give your claim the best chance of success from the outset, that you instruct a suitably qualified superannuation claims lawyer to help you make the claim. Attwood Marshall Lawyers can be contacted any time on 1800 621 071 and are here to help you throughout the process.

In most cases, there are no time limits to make a superannuation claim, however claims should be lodged at the earliest opportunity.

If your claim has been rejected, a time limitation will apply to appeal the decision. If your claim is not commenced in court by the time your time limit lapses, your claim is likely to be precluded.

The earlier you obtain legal advice about your superannuation claim the better to ensure you can access the benefits you are entitled to.

Attwood Marshall Lawyers offer a No Win, No Fee guarantee for superannuation, insurance and TPD claims. This means that you will only pay our fees if you win your claim.

In most cases, we offer a fixed fee. Contact us any time on 1800 621 071 to find out more about our fixed fees and no win no fee policy
