The importance of having your documents certified correctly – By Christine Martin – JP Qual (NSW & QLD)

There are many instances where you will be required to provide a copy of an original document which is to be certified by a suitably qualified person

Over time there have been some changes to the wording requirements which are acceptable by the Land Titles registry and it is very important that you check the wording of your certification to ensure that it is up to the current requirement.  Many Justices of the Peace may still be using a stamp or wording that is very similar but an older version of the current requirement and this could result in your supporting documents being rejected on typical applications ie First Home Grant; First Home Stamp Duty Concession and other commercial documents which may be required by your Bank in support of a finance application.

In a recent example where a client had provided a certified copy of a document to their bank as requested, settlement was arranged to take place and then late on the day before settlement the settlement/security team at the bank noticed that older wording had been used and then rejected the document in support.  The client and his solicitor had then to source the original document (which is sometimes very difficult) and have it properly certified and delivered to the nearest branch of the bank, who could then relay the message to bank’s securities department.  Whilst this was done as quickly as possible, settlement had to be rescheduled causing additional costs to be incurred to the client.
