Attwood Marshall Lawyers is pleased to announce that Estate Litigation Associate Lawyer, Martin Mallon, has been promoted to a Senior Associate.

Having joined the firm as an Associate Estate Litigation lawyer in August 2020, it didn’t take Martin long to showcase his client advocacy and strong litigation negotiation skills.

Martin has not only taken on a high load of cases during his time at the firm but has achieved exceptional results for his clients. This is proven by the flood of 5-star reviews Martin has received on Google from his clients. We value our client’s feedback, and it is in this feedback that we can identify that Martin delivers on our firm’s intent, that being to help people and change their lives for the better.

As a dedicated and hardworking litigator, Martin leaves no stone unturned when trying to achieve the best possible outcome for his clients.

Upon joining the firm, Martin also wasted no time to commit to the firm’s public education strategy and take part in activities including appearing on Radio 4CRB’s Law Talks program, edifying listeners on the intricacies of estate litigation. Martin’s radio segments helped generate significant enquiry for Attwood Marshall Lawyers and was extremely well-received by the radio station’s highly engaged audience.

He has established himself as a thought leader by regularly producing educational articles and video case studies which are published on a number of digital platforms. Through this content, Martin strives to help those most vulnerable in our community and ensure everyone understands their legal rights in matters related to Wills and estates.

Martin’s Background

Martin completed his Bachelor of Laws (Hons), Postgraduate Diploma in Legal Practice and Master of Laws (Corporate and Commercial Law) at Bond University and is a high academic achiever. He has been admitted as a solicitor in the Supreme Court of Queensland and High Court of Australia.

Martin has over 14 years’ experience in the legal industry and since his admission as a solicitor, he has worked in small, medium and large nationwide law firms, practising almost exclusively in the area of wills and estate litigation. He has developed a strong passion in estate litigation and using his legal knowledge to effectively advocate for his clients. Martin has experience in dealing with legally challenging and factually complex matters and has an innate ability to draft legal documents in a concise and effective manner. He is comfortable appearing before QCAT, the Magistrates, District and Supreme Court (without Counsel) when appropriate.

Martin strongly believes that legal advice and representation should be accessible to everyone regardless of their financial position or background. He strives on advocating for people who cannot fight for themselves to achieve positive results for them. Martin genuinely cares about helping his clients and resolving their matters.

Martin acts for both Applicants and Respondents across a range of matters including, but not limited to:

  • Family provision applications (contesting and defending);
  • Validity of testamentary documents (Wills);
  • Applications for Probate in solemn form;
  • Applications to remove executors;
  • Executors in dispute with co-executors and/or beneficiaries;
  • Representing beneficiary’s interests under an estate;
  • Representing applicants in complaints to the Australian Financial Complaints Authority;
  • Testamentary capacity issues;
  • Elder abuse including powers of attorney disputes and compensation to estates; and
  • Disputes against the Public Trustee of Queensland and the New South Wales Trustee and Guardian.

This year Martin was announced as a finalist of the Lawyers Weekly Australian Law Awards 2021 for Regional/Suburban Lawyer of the Year. Martin is also a Secretary and Board Member of My Community Legal Inc and regularly volunteers his time assisting vulnerable and disadvantaged members of the Gold Coast community. 

He is a member of the Society of Trust and Estate Practitioners (STEP), a worldwide professional association for those advising families across generations. STEP promotes best practice, professional integrity and education to their members.
