Superannuation Claims – Total & Permanent Disability (TPD)

Compensation Law

Helping you claim what you're entitled to when you cannot work due to injury or illness

When you cannot work or earn an income because of an injury or illness, it can be devastating. Most workers have Total and Permanent Disability (TPD) insurance through their superannuation fund with a sum of money that can be claimed when you cannot work. Other types of insurance payments and benefits are also frequently available.

If you are unable to work due to an injury or illness, you may be able to claim multiple types of superannuation and insurance, including:

  • Total and Permanent Disability (TPD)
  • Income Protection Insurance Claims
  • Life Insurance or Death Benefits
  • Trauma Claims
  • Early release of superannuation

TPD Claims

Total and Permanent Disability claims can involve a substantial lump sum payment at a time when you need it most. If you cannot work because of an injury or medical condition, we may be able to assist you to claim a TPD lump sum payment. We can access your TPD policy and advise you as to your entitlements to make a claim.

The terms and conditions for TPD claims usually differ between insurance policies. For this reason, it is important to speak to one of our experienced TPD and Superannuation Lawyers to obtain timely, accurate advice about your right to claim a lump sum payout or insurance benefitsOften people have more than one TPD lump sum available to them.

Sometimes people (or their financial advisors) try to run their own TPD claims to save on legal fees only to have their claims unfairly rejected by the fund or insurer.  Once we are contacted, it can be much more difficult to reverse those decisions or correct any mistakes made prior to our involvement.

Engaging qualified lawyers significantly boosts your chances of success with your TPD claim and the likelihood of an early payout (as opposed to lengthy litigation).  Attwood Marshall Lawyers are superannuation, insurance and TPD specialists. Our team are trained to access your full benefits to ensure you receive everything you are entitled to, as quickly as possible.

To
make an Income Protection claim, you must demonstrate that you are unable to work because of your injury or illness and that you are currently not performing any work duties. An Income Protection claim, or salary continuance payment, normally pays you up to 75% of your usual income on an ongoing basis for a set period of time (whether 2 years or up to retirement age).

To claim Life Insurance or Trauma, you must demonstrate that the terms of the relevant insurance policies are met.

Every insurance policy is different. It is imperative that you obtain legal advice as early as possible to understand the insurance policies you have

If you have appropriate cover under your superannuation, or an insurance policy, your insurer will pay for your benefits.

The amount you can claim will depend on the terms of your policy. Once you have instructed our compensation team to make enquiries on your behalf, we will be able to provide accurate estimates of your entitlements.

Most TPD claims, Income Protection claims, and Life Insurance claims take between 6 and 18 months to settle. More serious or complicated claims may take longer, whilst some claims are paid out quite quickly depending on the circumstances.

If your claim is rejected, you will have an avenue to appeal the insurer’s decision. If your appeal is unsuccessful, you may be able to take the matter to court depending on the circumstances.
