Attwood Marshall Lawyers welcomes Commercial Litigation Senior Associate Jade Carlson to the team

We’re excited to welcome Commercial Litigation Senior Associate Jade Carlson to Attwood Marshall Lawyers this past month as the litigation team in the firm continues to grow. Jade joins us at a time that we are seeing increasing demand for commercial litigation and class actions. Jade is a very experienced, seasoned litigation lawyer who shares our intent to help people and change their lives for the better. She will be an asset to our firm and to our clients, explains Attwood Marshall Lawyers Legal Practice Director Jeff Garrett.

Meet Jade Carlson

Jade has worked exclusively in Commercial Litigation since 2012.

After graduating with a Bachelor of Laws (with Honours) and Bachelor of Business from Griffith University in 2012, Jade went on to complete her Practical Legal Training through the College of Law and was then admitted in the Queensland Supreme Court in 2013 and to the High Court of Australia in 2016.

Jade has practised exclusively in the areas of Commercial Litigation, Construction, and Insolvency for more than 9 years, and joins Attwood Marshall Lawyers Commercial Litigation team led by Partner and NSW Law Society Accredited Specialist Dispute Resolution, Charles Lethbridge. She is based on the border of Queensland and New South Wales at our Coolangatta Office, but will be regularly attending our Robina Town Centre and Brisbane City offices.

Jade prides herself on building a strong rapport with her clients so that she can clearly identify their individual needs and objectives. She understands that the litigation process can be quite overwhelming for many people and always explains the law and her strategy in a clear and simple way, putting her clients at ease, and does her best to ensure they make informed decisions.

She has been instrumental in attaining extraordinary results in complex Australian Consumer Law disputes, property disputes, defamation matters, contractual disputes, body corporate disputes, employment disputes and building and construction matters both in Queensland and New South Wales.

Contract disputes: Contracts can come undone at any time and especially during a recession. When one party to a contract does not meet their obligations, costly issues can arise. Some of the issues we commonly see are when one party fails to provide a product or service to the standard agreed upon in the Contract, when there is a breach of confidentiality or intellectual property rights, or when someone has failed to comply with the terms and conditions of the Contract. If a dispute over a Contract arises, it is important to get advice early on to understand your rights and obligations under the Contract, and what steps to take next to resolve the matter effectively without it escalating to litigation.  

Company and business disputes: Disputes between business partners, directors and shareholders are relatively common.  We often see arguments over contributions or effort and differing opinions as to the management and direction of a business invariably lead to disputes. We believe in presenting our clients with viable options that will ultimately save them time and money and give all parties greater control over the outcome. We always try to resolve business disputes quickly so that there is minimal interference to the business’ operations.

Building & Construction Disputes: This is an area of law that has seen significant demand in the COVID era, with many homeowners seeking compensation after putting their trust in incompetent builders and being left with a house that has building defects, structural issues, or is simply incomplete. Our team are well-versed at assisting homeowners and builders in resolving disputes that arise throughout the course of construction.

Defamation Disputes: We have seen disputes in relation to defamation increase given the rise in social media platforms and online media generally. Publications, carrying defamatory imputations, now have the capacity to reach a large audience instantaneously.   Whether you are an aggrieved person who has been defamed, or a person who published defamatory material who has been accused of defaming a person, we are here to assist you to resolve your defamation dispute.

Insurance disputes: Insurance companies are renowned for using tricks of the trade to deny valid insurance claims. Our Commercial Litigation team have extensive experience going up against insurers and ensuring our clients get the most out of their policies to claim everything they are entitled to. From business interruption insurance, to insurance for natural disasters, it all comes down to the fine print. Our lawyers understand how devastating it can be when someone has experienced an event that leaves them needing to make a claim on their insurance. To then be denied their claim can be gut-wrenching. Banking Disputes: Since the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry in 2019, we have taken on a significant number of clients involved in banking disputes. From irresponsible lending and fraudulent financial advice to being charged exorbitant fees and interest, the major banks have had a lot to answer for over the past few years.
