In Queensland, the previous three-year time limitation (i.e. 3 years from your 18th birthday) for claims involving victims of child sexual abuse was recently removed.

It does not matter how long ago the abuse was endured – victims of child sexual abuse or historical abuse can bring a historical abuse claim for compensation at any time.

We recommend that you contact Attwood Marshall Lawyers as soon as you are comfortable to do so, to discuss your matter and determine your entitlements to claim compensation for the abuse you suffered.

Yes.

Historically, abuse claims have often involved little by way of reparations, empathy, understanding, or compensation being afforded to the victims of abuse. There once were problems faced by victims when trying to prove the abuse occurred many years after the event. Even where abuse was proven, the amount of compensation awarded was minor in comparison to the abuse the victim had endured.

This is no longer the case and those obstacles have since been removed so abuse survivors can have easier access to the compensation, justice and vindication they deserve.

When you make an abuse claim with Attwood Marshall Lawyers, we will guide you through and take care of the entire process. In addition to our expert lawyers and staff, we have access to leading abuse barristers, counsellors, support groups, psychiatrists, doctors, specialists, liability experts, police, investigators and other parties that are on hand to assist with your claim.

Most importantly, we are here to offer our support and advocate on your behalf – every step of the way.

We recommend that you obtain legal advice at the earliest opportunity.

We will assist you with the process of making the necessary steps to proceed with your claim.

Whilst there are no guarantees, most abuse claims resolve out of court at confidential, settlement conferences – where we talk on your behalf, so you do not have to (unless you want to tell your story).

Abuse claims typically take 6-18 months, unless they are unexpectedly complicated. Once we have discussed your situation with you, we can give you a more realistic idea of the likely timeframe your claim will take.

The amount of compensation you can claim depends on many variables relevant to your personal situation and circumstances.

Compensation can often include pain and suffering, income or wage loss, treatment costs, care and assistance or home help costs.  Depending on the size and type of claim, you may also be able to claim a significant contribution to your legal fees from the defendant.

Our Brisbane compensation lawyers have acted for victims of abuse and mistreatment in Brisbane for 75 years.

Our lawyers are trained to listen and connect with you to ensure that we understand your story and what is important to you.

Our Brisbane team are leaders in the compensation law industry.

We act on a No Win, No Fee basis.

We know that this can be an overwhelming, confronting process for abuse survivors. We are here to assist you in every way that we can to ensure that you achieve your optimum result in the shortest time and with as little stress as possible.
