Compensation Law Senior Associate Yasmine Chalvatzis spoke with the Gold Coast Bulletin about the duty of care owed by health providers when concerns are raised about a staff member’s conduct.
The story follows charges laid against a former Gold Coast Hospital and Health Service mental health nurse accused of sexual assault and other offences against children in his care. He denies the allegations.
“Where concerns are raised about a staff member’s professional performance, particularly in relation to vulnerable patients, it is expected that the organisation will assess the risks and take reasonable steps to protect patients,” Yasmine said.
She noted that a breach of this duty could expose a provider to civil action from affected patients or their families seeking compensation for negligence.
