What are the time limits for making a personal injury claim in New South Wales?
Time limits vary depending on the type of claim:
- Motor vehicle accident claims: Most claims have a strict 3-year time limitation from the date of the accident.
- Workers compensation claims: Notify your employer as soon as possible. Lodge the claim within 6 months from the date of injury or illness (or death). For common law lump sum damages, the limitation to commence court proceedings is typically 3 years from the date of injury or illness.
- Occupiers and Public liability: A claimant must serve a letter of demand on the negligent party and commence the claim in court within 3 years of the accident.
- Institutional Abuse: Time limits for making an institutional abuse claim have been removed. This means that it does not matter how long ago the abuse happened – victims of child sexual abuse or historical abuse can bring a historical abuse claim for compensation whenever they are ready to do so.
- Superannuation/TPD Claims: There are usually no time limitations that apply to superannuation claims, however, claims should still be lodged as soon as possible. If your claim is rejected, you then have a time limit that will apply to appeal the decision.
- Medical Negligence Claims: You generally have three years from the “date of discoverability” to commence court proceedings for a medical negligence claim. The date of discoverability is the point in time when you first knew (or reasonably ought to have known) that you suffered a personal injury, that the injury was caused by another person’s fault or negligence, and that the injury was serious enough to justify bringing a claim. In addition to this, there is a long-stop limitation of 12 years from the date of the negligent act or omission – meaning that, regardless of when you discovered the injury, you cannot bring a claim more than 12 years after the negligence occurred. The court may, in limited circumstances, grant an extension of time. However, these extensions are exceptional and not guaranteed.
