What does No Win, No Fee actually mean?

No Win, No Fee means our lawyers will take on your case without charging you any legal fees upfront, and if your claim is not successful, you are not charged our professional fees for the work we have done. If your claim succeeds, our fees and costs are paid as outlined in the Costs Agreement which is entered into between yourself and your lawyer before proceeding with the claim.

We also do not charge an uplift fee. Some law firms may charge an uplift fee if your claim is successful. This is an additional amount charged on top of the professional legal fees you would otherwise pay, reflecting the risk of taking on your claim on a No Win, No Fee basis.

The Costs Agreement sets out exactly how costs are calculated and what you can expect at every stage. We believe in complete transparency: your costs will be explained to you in plain English before you commit to anything, so you always know where you stand.

How legal costs and disbursements work

One of the most common questions we’re asked is how much a No Win, No Fee claim actually costs. Our legal fees are based on the time and work involved in running your claim, not a percentage of your compensation. This matters: it means our fees are transparent, and your final payout isn’t eroded by a percentage cut.

Disbursements are the out-of-pocket expenses paid to third parties during your claim, which cover things like medical reports and court filing fees.

While some firms agree to pay these fees on behalf of their client, some law firms use litigation loans to fund these expenses, effectively borrowing money at commercial rates.

Often, the interest rates on these loans are very high and individuals can be charged the interest on top of the usual legal fees.

Attwood Marshall Lawyers does not take out litigation loans and we cover all the disbursements and outlays on cases accepted on a No Win, No Fee basis. This means no additional interest is accrued on these costs.

It means you pay no upfront legal fees to start your claim, and if your claim is unsuccessful you are not charged our professional fees for the work we’ve done. If you win, our agreed fees and costs are settled from your compensation.

No. “No Win, No Fee” describes when legal fees become payable; it does not mean every law firm charges the same amount or structures its costs in the same way.

Not all No Win, No Fee agreements are the same. 

When comparing lawyers, ask how professional fees are calculated, whether an uplift fee applies, how disbursements are funded, whether interest is charged on those disbursements, and what costs could become payable if the claim is unsuccessful.

At Attwood Marshall Lawyers, we explain our Costs Agreement and how costs work before your claim proceeds.

If you lose your case, we will not charge you for our legal costs and disbursements, provided we do not recover damages and/or costs from the insurer in relation to your matter.

However, a no win no fee arrangement does not protect you from costs that a court may order you to pay to the other side. If you lose your case, the defendants and/or their insurance company may ask the court to order you to pay their legal costs.

These costs are separate from our legal fees. While we will not charge you our costs and disbursements in the circumstances explained above, we do not cover costs that are awarded against you in favour of the defendants or their insurer.

No. There are no upfront legal fees to begin a claim under our No Win, No Fee guarantee. In most matters we also fund disbursements — such as medical and court fees — as your claim progresses.

An uplift fee is an additional fee that some lawyers may charge under a conditional or No Win, No Fee costs agreement if a matter is successful.

In certain circumstances, Queensland law allows an uplift fee of up to 25% of the legal costs otherwise payable, excluding disbursements.

Attwood Marshall Lawyers does not charge an uplift fee on claims accepted under our No Win, No Fee arrangement.

Our professional fees are calculated in accordance with the Costs Agreement provided to you before your claim proceeds.

Many people confuse the terms “No Win, No Fee” and pro bono.  “No Win, No Fee” is taking on a case subject to being successful and obtaining damages or a payment as the pre-condition to charging.

If a lawyer takes a matter on a “pro bono” basis they usually do not charge anything to act on the matter, even if the matter settles.

While some large law firms take on a certain percentage of pro bono cases, it is becoming increasingly difficult for lawyers to act pro bono. Lawyers are the same as other business owners and have expenses and overheads to pay. If they are taking on “No Win, No Fee” cases which can take years to result in a judgment and costs to be paid, it is very difficult for some lawyers to fit in doing pro bono work as well as the “No Win, No Fee” cases.
