Superannuation and TPD Claim Lawyers Melbourne

No Win, No Fee

Helping you claim everything you are entitled to if you have suffered an injury or illness and cannot work.

Many people are not aware that they hold a Total and Permanent Disability (TPD) policy through their superannuation fund. TPD insurance covers you in the event you suffer an injury or illness that prevents you from working. When you choose to make a superannuation insurance claim, it can give you the financial security you need for your future. In addition to claiming TPD insurance, you may also have an income protection insurance policy which you can claim against which can assist you with your costs of living and ongoing medical treatment expenses.

TPD compensation is usually paid as a single lump sum payment. In some cases, there are superannuation claim funds that pay annual instalments on the basis you continue to be deemed as totally and permanently disabled.

Each insurance provider will have its own set of terms and conditions that apply to various policies. For this reason, it is important to speak to an experienced TPD lawyer in Melbourne so that you can ensure you gain access to all of your entitlements and that you get advice about your specific situation.

Our expert compensation law team can assist you with claims regarding:

  • Total and Permanent Disability (TPD)
  • Income protection insurance
  • Trauma
  • Early release of superannuation
  • Life insurance or death benefits

You may only get one shot at making a TPD or insurance claim, so it is imperative that you obtain trusted advice at the earliest opportunity. By getting advice from an experienced TPD lawyer. By doing so, you can ensure your case is handled efficiently, you avoid any unnecessary delays or mistakes, and your lawyer keeps the insurer accountable.

A superannuation claim can change your life and give you the financial security you need after suffering a significant injury or illness. It is our intent to support you throughout the entire process and to reduce the stress on you. We will challenge the insurer and hold them accountable so that you can receive all the entitlements you have available to you.

FAQs on enlisting TPD lawyers

If you are no longer able to work due to an injury, disability, illness, or medical condition, you may be eligible to make a superannuation claim.

You may be entitled to claim:

  • Total and Permanent Disability (TPD)
  • Income Protection
  • Life Insurance
  • Trauma

Our team can investigate any insurance policies you hold and provide you with comprehensive advice about your entitlements and the best way to make a claim.

To give your TPD or superannuation claim the best chance of success, we recommend that you discuss your unique circumstances with a TPD lawyer who can make enquiries on your behalf and help you with the paperwork and submission. Contact our team any time on 1800 621 071

TPD Claims:

To make a TPD claim, you will need to demonstrate that you are unable to work because of an injury or illness, and that your medical condition and incapacity for work fit the terms of your TPD policy. Different TPD policies can include different terms and conditions such as:

  • “that you cannot return to work in any occupation”; or
  • “that you cannot return to work in your usual occupation”.

The definition within your TPD policy can have a significant impact on what you may be entitled to claim. Once we can demonstrate that you fit the terms of your policy, we can assist you with completing the required paperwork and putting together the documentation you need for your submission to the insurer.

Income Protection:

To make a claim on your income protection policy, you must demonstrate that you are unable to work because your injury or illness currently prevents you from doing so.

We can help you understand the terms and conditions of your policy and what evidence you need to put forward to show that you meet these terms.

Life Insurance or Trauma Claims:

To make a claim on your life insurance or trauma policy, you must demonstrate that the terms of the policy are met. Our team can review your policy to help you understand what terms and conditions apply to you.

As every insurance policy is different, it is vital to your claim that you seek legal advice at the earliest opportunity. Attwood Marshall Lawyers are here to help you access everything you are entitled to and will help ensure your claim has the best chance of success from the outset.

If you hold the necessary insurance cover under your superannuation, or through an alternative provider, it is the insurer who is responsible to pay your benefits.

The amount you may be entitled to claim will depend on the terms of your specific policy. When you instruct our compensation team to make enquiries on your behalf, we will be able to determine exactly what entitlements you have access to as stipulated in your insurance policies.

Many people hold multiple insurance policies and may be able to make multiple claims.

In most cases, superannuation and TPD claims settle between 6 and 18 months. More serious or complex cases may take longer to settle, whilst some claims can be paid out quite quickly. We will be able to provide you with a more accurate estimate when our team get a better understanding of your situation and the type of insurance you hold.

If your claim is rejected by the insurer, you will have the opportunity to appeal the decision. If your appeal is unsuccessful, you may be able to take the matter to court.

To give your TPD or superannuation claim the best chance of success from the outset, we recommend that you get trusted advice from a specialist TPD lawyer who can help you with the paperwork and submission, leaving no stones unturned. To discuss your situation, contact our team any time on 1800 621 071

In most cases, there are no time limitations to make a superannuation or TPD claim.

However, a time limitation does apply if your claim has been rejected by the insurer and you wish to make an appeal. If your claim is not commenced in court by the time your time limit lapses, your claim is likely to be precluded.

We recommend that you seek legal advice and assistance at the earliest opportunity to give your claim the best chance of success.
