Family Law Funding Option - JustFund
Financial assistance for family law matters
Navigating separation, divorce, and other family law matters can be emotionally and financially challenging. For many people, legal costs can become a barrier, particularly during a time of financial uncertainty.
Attwood Marshall Lawyers is an accredited partner of JustFund, a specialist Australian provider of family law finance.
JustFund offers tailored funding solutions designed to assist eligible family law clients with the cost of legal fees and disbursements, and in some cases, approved living expenses, during family law proceedings.
Family law funding enables eligible clients to access financial support for their matter without upfront payments. In most cases, repayment occurs upon finalising a property settlement, helping clients manage cash flow during separation or divorce.
This type of funding can help level the playing field by allowing you to obtain quality legal representation when you need it most, without compromising your financial stability.

Frequently Asked Questions
JustFund provides a line of credit for eligible family law matters. This line of credit is a form of litigation funding and is different from traditional loans or other forms of legal finance, offering a flexible solution tailored to family law needs. Unlike a traditional loan, repayment is generally deferred until your matter resolves and is repaid from settlement proceeds.
Family law finance is asset-based lending secured against your expected settlement amount (assets), and JustFund’s credit line is tailored and lawyer-supervised to ensure it meets the specific requirements of your case.
JustFund understands the unique financial pressures associated with family law disputes and assesses each application on its individual merits, rather than relying solely on traditional lending criteria.
JustFund provides a better financing solution than other litigation funders by offering more flexibility that can be applied toward covering legal expenses and achieving a final property settlement.
JustFund funding may be used to cover:
- Legal fees
- Court fees
- Expert reports and disbursements
- Other approved legal costs associated with your family law matter
This allows clients to progress their legal matter without the immediate financial burden of upfront legal costs.
JustFund funding may be available for:
- Property settlement matters
- Parenting matters that are connected to a property matter
Unfortunately, parenting matters alone are not eligible for funding through JustFund.
Eligibility is assessed on a case-by-case basis, taking into account the nature of the legal matter, anticipated settlement entitlement, and individual circumstances.
It is advisable to seek legal advice before making a decision about your family law funding option or before applying to the Court.
- Initial Legal Advice: Speak with your Attwood Marshall Lawyers family lawyer to assess whether JustFund funding may be suitable for your matter. Parties can also apply to the Court for assistance with family law legal fees, including support for spousal maintenance.
- Application Submission: Your lawyer can assist in submitting a JustFund application on your behalf, providing the necessary legal information to support the assessment.
- Assessment by JustFund: JustFund will review your application, typically within one week, considering your legal entitlement and personal circumstances.
- Approval & Documentation: If approved, you will be asked to electronically sign a Funding Agreement and Letter of Instruction.
- Accessing Funds: Once approved, funds are advanced directly to cover your approved legal expenses as your matter progresses.
- Repayment at Settlement: Repayment generally occurs when your legal matter concludes, and settlement funds are received.
You pay the amount used for legal fees and expenses, plus applicable fees and interest, from your settlement proceeds once your family law matter settles. Repayment is required only for the amount you have used.
JustFund fees may include:
- Assessment & Administration Fee
Covers the cost of assessing your application and establishing the line of credit. - Invoice Processing Fee
Covers processing and payment of legal invoices and monitoring of your matter. - Interest
Charged only on the amount drawn down, calculated from the date of each drawdown. No interest is charged on unused credit.
For the most current fee information, clients should contact JustFund directly.
- Minimum loan amount: $5,000
- Maximum loan amount: No fixed maximum
The approved amount depends on your individual circumstances and legal entitlement.
Security is not always required. Each application is assessed individually, and funding may still be available even if you are not listed on a property title.
JustFund looks beyond traditional lending criteria. Credit score, employment history, or income are not determinative factors. Applications are assessed holistically, focusing on legal entitlement and individual circumstances.
Most applications are assessed within approximately one week, provided all required information has been supplied.
